Short Final™

Short Final Terms of Use

Version 2.0. Effective 10 October 2026.

Updated 15 October 2026: Short Final is for players aged 13 and up. Sections 2.2 and 2.3 now say so, and a player under 13 cannot use the Game.

Short Final is a game by Thin Air Studios LLC, Colorado, USA. Thin Air Capital is a trade name of Thin Air Studios LLC.

The short version

This summary is there to help you read the Terms. If it ever differs from the full Terms below, the full Terms apply.

1. Who we are and what these Terms cover

1.1 These Terms are a contract between you and Thin Air Studios LLC, Colorado, USA ("we", "us" or "our").

1.2 These Terms cover Short Final for Android, including its screens, the online boards, the sharing features, the in-app Terms of Use, Privacy Policy and Licences pages, anything else we provide with the game, and the browser demo on our website at thin-air-studios.github.io/demo/ (together, the "Game").

1.3 Our Privacy Policy explains how we handle information. It forms part of these Terms.

1.4 If you got the Game from Google Play, Google's terms apply as well (section 14).

2. Accepting these Terms

2.1 You accept these Terms by tapping "Agree & play" on the first-launch screen. If we make a material change later, we will ask you to agree again (section 19). If you don't agree, don't play the Game.

2.2 You must be 13 or older to use the Game, to accept these Terms, to sign in to Google Play Games, and to post ranked scores to the online boards.

2.3 The Game is for players aged 13 and up, and a player under 13 can't use it. The browser demo asks no age and keeps nothing about its players. The Game asks each new player for the year they were born and, where the year alone does not tell whether they are 13 yet, the month too. A player under 13 is stopped at that point, by a screen that says the Game is for ages 13 and up. If you are a parent or guardian and believe a child has used the Game, you can email thinaircapital@gmail.com, as the Privacy Policy explains.

2.4 If you accept these Terms for a company or other organization, you confirm that you are allowed to do so, and "you" means that organization.

3. Your licence to use the Game

3.1 We grant you a limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and play the Game on Android devices you own or control. You may use it only for your personal, non-commercial entertainment, and only as these Terms allow.

3.2 This is a licence, not a sale. You don't own the Game or any copy of it, and nothing in these Terms transfers any ownership to you.

3.3 We may change, add to, or remove features of the Game at any time. Some features need an internet connection, and some depend on third-party services (section 14). Those services can change or stop, and features that depend on them may stop working too.

3.4 We may stop making the Game available, or any part of it, at any time. Where it is reasonable to do so, we will tell you in the Game first.

3.5 You may make pictures and videos of the Game, including the videos the Game makes from a game you played, and share or post them publicly for your personal, non-commercial entertainment, including on social media. A video may carry the Game's music as it sounds in the Game. Keep the Game's name with anything you post. The music, art and other content in the pictures and videos remain ours or our licensors'. This section 3.5 is an exception to sections 4.1(a) and 4.1(g) for those pictures and videos only. It does not allow you to copy or distribute the Game itself, or any part of its code or data.

4. What you may not do

4.1 You agree not to:

(a) copy, clone, or imitate the Game, or any part of it, including its design, rules, gameplay systems, art, sounds, music, text, or the way it turns live feed data into play, for any product or service of your own or anyone else's;

(b) reverse engineer, decompile, disassemble or otherwise try to discover the source code, data files or inner workings of the Game, except where a law that cannot be overridden by contract allows it;

(c) scrape, crawl, mirror, download in bulk, or extract data from the Game, its data files, our servers, or the online boards, or use bots, scripts or other automated means to do so;

(d) use the Game, its content, or any data taken from it to train, fine-tune, evaluate or build any artificial-intelligence or machine-learning model;

(e) cheat; modify, interfere with or tamper with the Game, its data, its requests or its replays; create or use software that automates play; or exploit a bug to gain an advantage, especially on ranked play or the online boards;

(f) remove, hide or change any copyright, trademark, credit or licence notice in the Game;

(g) sell, rent, lease, lend, sublicense, distribute or host the Game or any part of it, or charge anyone for access to it, or make copies available through any channel other than the official app stores and our official channels;

(h) impersonate another player, a company, a public figure or an organization, including by choosing a name that does so;

(i) harass, threaten, abuse or harm other players or anyone else, or use the Game to send or display unlawful, hateful, sexual, violent or otherwise offensive content;

(j) use the Game in any way that breaks the law or these Terms, or that could damage, overload or disable the Game, our servers or other people's use of them.

4.2 Parts of the Game's data and software are provided under third-party licences. Those licences are listed in the Licences page in the Game, and nothing in these Terms takes away any right those licences give you.

5. Ownership and trademarks

5.1 Short Final™ and everything in it belong to Thin Air Studios LLC. All rights are reserved under the copyright, trademark and other intellectual-property laws of the United States and other countries, and under international treaties including the Berne Convention. Anything these Terms don't expressly grant you is reserved.

5.2 Short Final™ and the Short Final logo are trademarks of Thin Air Studios LLC. Thin Air Capital is a trade name of Thin Air Studios LLC.

5.3 Airline names, aircraft types, airport names and other third-party names or marks that appear in the Game belong to their owners. They appear to describe real planes and places. Short Final is not affiliated with, sponsored by or endorsed by any airline, airport, aircraft maker, data provider or other third party named in the Game. The Licences page in the Game credits the data and software we use.

6. Feedback

6.1 If you send us ideas, suggestions, bug reports or other feedback about the Game ("Feedback"), you agree that we may use it for any purpose, without payment to you and without any obligation to you. You grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable licence to use, copy, change and build on Feedback.

6.2 Feedback is not confidential. We don't have to use it.

7. Names, scores and replays you share with us

7.1 Your name on the online boards is your Google Play Games display name, or a callsign (such as "Pilot 4821") if your name is hidden or has been replaced. You can choose whether your name shows on World boards. You are responsible for the name you use in Google Play Games.

7.2 We may check names. We may replace a name with a callsign, without telling you first, if the name:

(a) breaks these Terms or the rules in the Game, including names that are offensive, hateful, sexual, threatening, or that impersonate someone else;

(b) has been reported under the report process in the Game by three or more different players; or

(c) is misleading.

Replacing a name doesn't remove your scores, unless section 9 also applies.

7.3 When you post a ranked score to the online boards, you give us the score and the replay of the game that produced it, together with the other details the Game sends. We use them to show your score on the boards, to check it, and for the other purposes in our Privacy Policy. Replays are kept only for the time the Privacy Policy describes. A score posted only to Google Play Games is not sent to us (section 9.3).

7.4 You're responsible for keeping your phone and your Google account secure. Tell us at the contact address in section 22 if you think someone else has used your name or your scores.

8. Entertainment only, and live data

8.1 Short Final is a game. It is not a flight-tracking, air-traffic-control, navigation or flight-planning tool. Do not use it for any of those purposes, or to make any decision about travel, flying, safety or an emergency.

8.2 The Game shows flight positions, weather and other information from third-party sources. That data may be wrong, late, incomplete or missing. Flights shown are approximate and simplified for play. The Game also shows simulated aircraft and simplified weather, and it doesn't always say which is which.

8.3 Maps, coastlines and surroundings are simplified. They are not suitable for navigation.

9. Ranked play, online boards and Google Play Games

9.1 A game is ranked only when the Game's rules say it is. Before each game, the Game shows whether it is Ranked or Unranked. A daily challenge has its own board. Only ranked games can post to the online boards or to Google Play Games boards. The rules for ranked play, including keeping one level for the whole game and the other conditions in the Game, form part of these Terms.

9.2 Cheating voids a score. If we reasonably believe that a score, replay or name was produced by cheating, tampering, bots, exploiting a bug, or otherwise breaking these Terms, we may remove it, void the result, remove the player from the boards, or stop that player from posting.

9.3 Every score posted to the online boards is checked by re-running its replay. We may refuse a score that does not match the replay, or that comes from a version of the Game we can no longer check. Scores posted to Google Play Games leaderboards are sent by the Game to Google. We don't receive their replays and we don't re-run them, so we don't check those scores. Google's rules apply to them.

9.4 You may remove your scores from the online boards at any time, by choosing "Remove my scores" in the Game or by emailing us (section 22). Removing scores from the online boards does not change the stats on your phone, and it does not remove scores already posted to Google Play Games.

9.5 Boards may be reset, paused, changed or closed, including when the rules for ranked play change and a new season starts. We don't guarantee that any board will be available, or that any score will stay on it.

9.6 The Google Play Games features (sign-in, achievements and leaderboards) are provided by Google under Google's terms (section 14). Google isn't a party to these Terms, and it doesn't run, operate or endorse Short Final.

10. Ending these Terms

10.1 You can stop using the Game at any time by uninstalling it. You can remove your online scores first with "Remove my scores", or ask us to remove them (section 9.4).

10.2 Your licence ends automatically if you break these Terms. We may also suspend or end your access to the Game, or to its online features, at any time if we reasonably believe you have broken these Terms, or if we must do so to comply with the law or to protect the Game or other players.

10.3 Ending these Terms does not affect sections 4, 5, 6, 7.3, 9.4, 10.3, 11, 12, 13, 15, 16, 17, 18 and 20, which continue to apply as far as they need to.

11. No warranty

11.1 THE GAME, ITS CONTENT, THE ONLINE BOARDS AND ALL DATA AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND.

11.2 TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTY THAT THE GAME OR THE ONLINE BOARDS WILL BE AVAILABLE, UNINTERRUPTED, SECURE OR FREE OF ERRORS OR HARMFUL COMPONENTS.

11.3 WE DO NOT WARRANT THAT ANY FLIGHT, WEATHER OR OTHER LIVE DATA IN THE GAME IS ACCURATE, COMPLETE OR UP TO DATE, OR THAT ANY RANKING OR SCORE SHOWN ON A BOARD IS CORRECT.

12. Limitation of liability

12.1 TO THE FULLEST EXTENT THE LAW ALLOWS, NEITHER WE NOR OUR OWNERS, EMPLOYEES, LICENSORS, SUPPLIERS OR DATA PROVIDERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, SCORES, PROGRESS, GOODWILL OR REPUTATION, ARISING OUT OF OR RELATING TO THE GAME OR THESE TERMS, EVEN IF WE HAVE BEEN TOLD THAT SUCH DAMAGES ARE POSSIBLE.

12.2 TO THE FULLEST EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE GAME OR THESE TERMS IS LIMITED TO FIFTY U.S. DOLLARS (US$50).

12.3 The limits in this section do not apply to any liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for fraud, or for willful misconduct. Some places do not allow certain limits, in which case our liability is limited to the smallest amount the law allows.

13. Indemnity

13.1 You agree to defend, indemnify and hold harmless Thin Air Studios LLC and its owners, employees and agents from any third-party claim, and any resulting loss, damage, fine or reasonable legal costs, to the extent it arises from your breach of these Terms, your misuse of the Game, or the name, content or messages you have put into the Game or the boards.

13.2 This section does not require you to cover losses caused by our own negligence or wrongdoing, and it does not apply where the law does not allow it.

14. Third-party services and Google Play

14.1 Google Play. If you downloaded the Game from Google Play, the Google Play Terms of Service also apply to your use of Google Play. Google is not responsible for the Game and does not have to provide support for it.

14.2 Google Play Games. Sign-in, achievements and leaderboards in the Game are provided through Google Play Games Services and are subject to Google's terms and privacy policy. Google is not a party to these Terms.

14.3 Data providers. The Game uses data and services from third parties, including OpenStreetMap contributors (through the Overpass API), The OpenSky Network, the NOAA Aviation Weather Center (aviationweather.gov), OurAirports, ACI World, and others. Their data and services are subject to their own licences and terms, which are listed in the Licences page in the Game. Where a third party's terms are stricter than these Terms for the same data, those terms apply to that data.

14.4 Other services. Your phone's operating system, text-to-speech engine, sharing apps, carrier and device are all provided by third parties under their own terms.

14.5 Links. The Game may link to websites that we don't own or control. We are not responsible for them.

14.6 Purchases. Short Final Pro is a one-time purchase sold through Google Play. Google Play sets and shows its price, including any taxes that apply. Refunds follow Google Play's refund policy, and we cannot issue refunds ourselves. Restore purchase brings Pro back on a phone signed in to the Google account that bought it. The free games and the daily challenge are part of the Game and stay free, as the Game describes them.

15. Disputes: informal resolution, then individual arbitration

15.1 Informal resolution first. Before starting arbitration or a court case, you and we agree to try to settle any dispute informally for at least 60 days. To start, email thinaircapital@gmail.com with the subject "Dispute", your name or display name, a short description of the dispute and what you want. We will reply and try to resolve it with you in good faith.

15.2 Binding individual arbitration. If the dispute is not resolved within 60 days, it will be decided by final and binding arbitration on an individual basis, under the Consumer Arbitration Rules of the American Arbitration Association ("AAA"), as changed by this section. The Federal Arbitration Act governs this section. The arbitrator decides any question about whether a dispute is covered by this section, except as sections 15.5 and 15.6 provide. The hearing will take place by video or telephone, or in the county where you live, unless you and we agree otherwise. We will pay the arbitration fees that the AAA rules say a business must pay. The arbitrator may award any remedy that a court could award on an individual basis. The award may be entered in any court that has jurisdiction.

15.3 No class actions. You and we may bring claims only in an individual capacity. Neither of us may bring or join any class, collective, consolidated or representative action or arbitration, and the arbitrator may not combine the claims of more than one person. If many similar claims are filed together, they will be handled under the AAA's procedures for multiple cases, and not as a class.

15.4 Jury trial waiver. If a dispute is decided in court rather than arbitration, you and we each give up the right to a jury trial.

15.5 Small claims. Either of us may bring an individual claim in small claims court instead of arbitration, if the claim is within that court's rules and jurisdiction.

15.6 Injunctions. Either of us may ask a court for an injunction to stop unauthorized use of intellectual property or cheating. Asking for an injunction does not waive arbitration of any other claim.

15.7 Opt-out. You may opt out of sections 15.2 to 15.4 within 30 days of first accepting these Terms. To opt out, email thinaircapital@gmail.com with the subject "Arbitration opt-out", your name or display name, and a statement that you opt out. If you opt out, the dispute will be handled under section 16 instead. Opting out does not affect any other part of these Terms.

15.8 Time limit. To the extent the law allows, any claim relating to the Game must be started within one year after the event that gave rise to it, or it is permanently barred.

15.9 This section survives the end of these Terms.

16. Governing law and courts

16.1 These Terms are governed by the laws of the State of Colorado and the federal laws of the United States, without regard to conflict-of-law rules.

16.2 Where section 15 does not apply (for example, because you opted out, or the claim is in small claims court), the state and federal courts in Colorado have exclusive jurisdiction, and you and we consent to their jurisdiction.

16.3 Your rights under consumer-protection laws that cannot be waived by agreement are not changed by these Terms. If you live outside the United States, you also keep any protections your local consumer law gives you that can't be waived by agreement.

17. Export, sanctions and eligibility

17.1 You must comply with the export and sanctions laws of the United States and any other country that applies to you. You may not use the Game if you are on a list of restricted parties published by the United States or other governments, or if you are located in a country or territory that is subject to a comprehensive embargo.

18. General

18.1 Entire agreement. These Terms, the Privacy Policy and the rules and notices shown in the Game (including the ranked-play rules and the Licences page) are the whole agreement between you and us about the Game. They replace any earlier agreement on the same subject.

18.2 Severability. If a court or arbitrator finds part of these Terms unenforceable, that part will be changed to the smallest extent needed to make it enforceable, and the rest of these Terms will continue to apply.

18.3 No waiver. If we don't enforce a part of these Terms, that does not mean we have given up the right to enforce it later.

18.4 Assignment. We may transfer these Terms to an affiliate or to a successor of our business, for example in a merger or sale of the Game. You may not transfer these Terms or your licence without our written consent.

18.5 Force majeure. Neither of us is responsible for delay or failure caused by events beyond our reasonable control, including internet, power or hosting outages, failures of third-party services, changes to app stores, natural disasters, war, or government action. This does not excuse payment of any amount owed.

18.6 Notices. We may give you notice of changes or other matters by showing it in the Game, on our website, or by email to the address on your account or the address you have given us. You give notice to us at the address in section 22.

18.7 Headings. Headings are for convenience only.

18.8 Language. These Terms are written in English. If they are translated, the English version controls.

19. Changes to these Terms

19.1 We may change these Terms from time to time. We will update the effective date at the top.

19.2 If a change is material, we will show the new Terms in the Game and ask you to agree to them before you use the online features again, and, where the change affects how you use the Game, before you continue to play. If you do not agree, stop using the Game and uninstall it. You can also remove your online scores (section 9.4).

19.3 For changes that are not material, the new Terms apply when they are posted in the Game or on our website. Continuing to use the Game after that means you accept them.

20. Survival and interpretation

20.1 Where these Terms say "including", the list that follows is an example and not a complete list.

20.2 The Game may be used only in the form these Terms describe. Nothing in these Terms gives anyone rights beyond those expressly stated.

21. Privacy

21.1 Our Privacy Policy describes what information we collect, why, and what choices you have. It is part of these Terms.
